1. Introduction
FITGYAL is committed to building a safe, supportive, and inclusive fitness community. This Acceptable Use Policy and Community Guidelines (“AUP”) outlines the rules and standards that all users must follow when using the FITGYAL mobile application, website, and all related services (the “Service”).
This AUP is part of our Terms of Service. By using the Service, you agree to comply with this AUP. Violations may result in content removal, account suspension, or permanent termination.
We want FITGYAL to be a place where everyone feels safe to share their fitness journey, celebrate progress, support each other, and have fun. These guidelines exist to protect our community and ensure a positive experience for all users.
2. Prohibited Content
The following types of content are strictly prohibited on the Service. This applies to all user-generated content, including but not limited to posts, photos, avatar images, dance videos, comments, direct messages, Squad names and descriptions, profile information, and livestream content.
2.1 Hate Speech & Discrimination
Content that promotes, incites, or glorifies hatred, discrimination, or violence against individuals or groups based on race, ethnicity, national origin, religion, gender, gender identity, gender expression, sexual orientation, disability, age, veteran status, immigration status, caste, or any other protected characteristic. This includes slurs, dehumanizing language, stereotyping, and coded language intended to demean.
2.2 Harassment & Bullying
Content or behavior that is intended to intimidate, degrade, humiliate, shame, body-shame, or otherwise target an individual or group. This includes persistent unwanted contact, name-calling, mockery, sharing embarrassing content, making fun of someone’s fitness level or body, encouraging others to harass someone, dogpiling, and any form of cyberbullying.
2.3 Threats & Incitement to Violence
Direct or indirect threats of violence, physical harm, or death against any person or group. Content that incites, encourages, or glorifies violence. Statements expressing intent to cause harm, even if framed as jokes or hypothetical scenarios.
2.4 Doxxing & Privacy Violations
Sharing, threatening to share, or soliciting private or personally identifiable information of others without their explicit consent. This includes real names, addresses, phone numbers, email addresses, financial information, workplace details, school information, and any other information that could be used to identify or locate someone.
2.5 Child Sexual Abuse Material (CSAM)
Any content that depicts, promotes, solicits, or facilitates the sexual exploitation or abuse of minors in any form. This includes real imagery, computer-generated imagery, AI-generated imagery, drawings, and written content. See our Child Safety Policy for complete details. Violations are reported to NCMEC and law enforcement immediately.
2.6 Nudity & Sexually Explicit Content
Pornography, full or partial nudity, sexually suggestive poses or content, sexual solicitation, and sexually explicit language or imagery. This applies to all content types including photos, videos, avatars, and text. Fitness and workout content is permitted but must not be sexually suggestive in nature.
2.7 Violence & Graphic Content
Graphic violence, gore, mutilation, animal cruelty, or content that glorifies, promotes, or trivializes violence and suffering. Content depicting real-world violence, accidents, or death (except for legitimate news reporting or educational content with appropriate context and content warnings).
2.8 Illegal Activity
Content that promotes, facilitates, instructs in, or glorifies illegal activities. This includes but is not limited to: drug trafficking or use of controlled substances, weapons sales, fraud, theft, hacking, copyright infringement, counterfeit goods, gambling where prohibited, and any other criminal conduct.
2.9 Spam & Deceptive Content
Unsolicited bulk messages, repetitive posts, promotional content for external products or services, phishing attempts, scams, pyramid schemes, multi-level marketing solicitations, fake engagement, misleading links, and any form of spam or deceptive content.
2.10 Health Misinformation
Deliberately false or misleading health, fitness, or nutritional information that could cause harm. This includes promoting unproven or dangerous treatments, making false medical claims, spreading misinformation about vaccines or established medical science, and promoting dangerous or extreme dieting practices.
2.11 Dangerous Challenges
Content that promotes, encourages, or provides instructions for dangerous physical challenges, stunts, or activities that could result in injury or death. This includes extreme diet challenges, dangerous exercise routines performed without proper supervision, and viral challenges that pose health risks.
2.12 Eating Disorder & Self-Harm Promotion
Content that promotes, glorifies, encourages, or provides instructions for eating disorders (including anorexia, bulimia, and other disorders), self-harm, or suicide. Content that sets unhealthy body image standards, promotes extreme caloric restriction, purging, excessive exercise as punishment for eating, or other disordered eating behaviors. Recovery content that shares personal experiences in a supportive context is permitted.
2.13 Impersonation
Misrepresenting your identity by posing as another person, organization, brand, or entity. Creating accounts that mimic or imply affiliation with other users, celebrities, organizations, or FITGYAL staff. Parody accounts must be clearly labeled as parody.
3. Prohibited Behavior
In addition to prohibited content, the following behaviors are strictly prohibited:
3.1 Harassment & Stalking
Persistent, unwanted contact or attention directed at another user. Following or monitoring someone’s activity in a way that causes distress. Repeatedly messaging someone who has not responded or has asked you to stop. Creating new accounts to contact someone who has blocked you.
3.2 Impersonation & Deception
Creating fake accounts, using someone else’s identity or likeness, or misrepresenting your affiliation with any person or organization. Using fake or misleading profile information to deceive other users.
3.3 Manipulation of FitCoin & Games
Any attempt to manipulate, exploit, or abuse the FitCoin system, mini games, sweepstakes, or any other gamification feature. This includes using bots, scripts, or automated tools to earn FitCoins; exploiting bugs or glitches; colluding with other users to manipulate outcomes; fabricating activity data; and any other form of cheating or unfair advantage.
3.4 Multi-Accounting
Creating or maintaining multiple accounts per person. Using alternate accounts to circumvent bans, suspensions, or enforcement actions. Using multiple accounts to manipulate FitCoin earnings, sweepstakes entries, or leaderboard rankings.
3.5 Automated Access
Using bots, scrapers, crawlers, or any automated means to access, interact with, or collect data from the Service without prior written authorization from FITGYAL. This includes automated posting, automated following/unfollowing, data scraping, and any other automated interaction.
3.6 Circumventing Security & Enforcement
Attempting to bypass, disable, or circumvent any security measures, access controls, rate limits, or enforcement actions implemented by FITGYAL. This includes using VPNs or proxies to evade IP bans, creating new accounts after being banned, and manipulating the reporting system.
3.7 Interference with the Service
Any activity that disrupts, interferes with, or degrades the performance of the Service. This includes denial-of-service attacks, spam attacks, introducing malware or viruses, and deliberately overloading our infrastructure.
4. Content Moderation Process
FITGYAL employs a comprehensive content moderation process that combines automated systems with human review:
- Automated pre-screening: Content is automatically scanned before publication using AI-based classifiers and hash-matching technology to detect prohibited content, including CSAM, nudity, violence, and spam;
- User reporting: All content includes a report button. Reports are reviewed based on priority, with child safety reports receiving the highest priority;
- Human review: Trained content moderators review flagged content and make enforcement decisions. Moderators are trained on our policies and guidelines and receive regular updates;
- Proactive monitoring: Our trust and safety team proactively monitors the platform for emerging trends, coordinated abuse, and policy violations;
- Escalation: Complex or high-severity cases are escalated to senior moderators or the trust and safety team lead for review;
- Documentation: All moderation actions are documented, including the reason for the action, the policy violated, and the evidence reviewed.
Our moderation team strives to review reported content as quickly as possible. Child safety reports are prioritized and reviewed immediately during business hours and within 24 hours at all other times. Other reports are typically reviewed within 48 hours.
5. Reporting Process
If you encounter content or behavior that violates this AUP, we encourage you to report it. Your reports help us maintain a safe community.
How to Report
- In-app report button: Tap the three-dot menu or report button on any post, comment, profile, message, or livestream, then select the appropriate violation category;
- Email: Send a report to support@fitgyal.us with details of the violation, including the offending user’s username and a description or screenshot of the content;
- Child safety reports: For urgent child safety concerns, email safety@fitgyal.us directly.
What Happens When You Report
- Your report is received and logged in our moderation system;
- A unique report ID is generated (you may receive this via notification);
- The content or behavior is queued for review based on severity and priority;
- A moderator reviews the report and the relevant content/behavior;
- An enforcement decision is made based on our policies;
- You may receive a notification about the outcome of your report (subject to privacy considerations).
Reporter protections: We do not reveal the identity of reporters to the reported user. Reports made in good faith will never result in negative action against the reporter. However, filing false or malicious reports is itself a violation of this AUP.
6. Enforcement Actions
Violations of this AUP may result in one or more of the following enforcement actions, depending on the severity, nature, and frequency of the violation:
Level 1: Warning
For first-time, minor violations, you may receive a warning notification explaining the policy violation. The offending content may be removed. Your account remains in good standing, but repeated violations will result in escalated enforcement.
Level 2: Temporary Suspension
For repeated violations or moderate-severity violations, your account may be temporarily suspended for a period of 24 hours to 30 days. During suspension, you will not be able to post content, send messages, participate in sweepstakes, or access most features. FitCoin earning is paused during suspension.
Level 3: Permanent Ban
For severe violations, repeated violations after prior enforcement, or patterns of abusive behavior, your account will be permanently terminated. All content will be removed. All FitCoins, subscription benefits, and sweepstakes entries will be forfeited without refund. You will be prohibited from creating new accounts.
Immediate permanent bans (bypassing graduated enforcement) apply to:
- CSAM or child exploitation of any kind;
- Credible threats of violence;
- Severe harassment or stalking;
- Distribution of CSAM or exploitation material;
- Illegal activity that poses a risk to user safety;
- Coordinated abuse campaigns;
- Any behavior that FITGYAL determines poses an immediate risk to the safety of our community.
Additional enforcement actions may include:
- Content removal;
- Feature restrictions (e.g., messaging, posting, livestreaming);
- FitCoin balance reset or adjustment;
- Removal from Squads;
- Sweepstakes disqualification;
- IP and device bans;
- Reporting to law enforcement.
7. Appeals Process
If you believe an enforcement action was taken against your account or content in error, you have the right to appeal:
- How to appeal: Send an email to support@fitgyal.us with the subject line “Appeal: [Your Username].” Include your username, the enforcement action you are appealing, and a detailed explanation of why you believe the action was taken in error;
- Appeal timeline: Appeals must be submitted within 30 days of the enforcement action;
- Review process: Appeals are reviewed by a different moderator than the one who made the original decision. The reviewing moderator will examine the content, context, and applicable policies;
- Response time: We aim to respond to appeals within 14 business days;
- Outcomes: Appeals may result in the enforcement action being upheld, modified (e.g., reduced suspension), or reversed. The appeal decision is final;
- Exceptions: Appeals are not available for CSAM-related violations or violations involving imminent threats to safety. These enforcement actions are final and non-appealable.
8. Cooperation with Law Enforcement
FITGYAL cooperates with law enforcement agencies when violations of this AUP involve criminal activity or threats to safety:
- Mandatory reporting: We report all identified CSAM to NCMEC as required by federal law (18 U.S.C. 2258A);
- Credible threats: We report credible threats of violence, terrorism, or imminent harm to relevant law enforcement agencies;
- Legal process: We comply with valid legal process, including subpoenas, search warrants, and court orders;
- Emergency disclosures: In emergency situations involving imminent risk of death or serious bodily harm, we may voluntarily disclose information to law enforcement without a court order;
- Evidence preservation: We preserve relevant evidence for law enforcement investigations and comply with preservation requests;
- User notification: Unless prohibited by law or a court order, we will notify users whose data is requested by law enforcement, unless doing so would jeopardize an investigation or endanger someone’s safety.
